With Bavaria at the head, the states of the Federal Republic of Germany are planning the new development of a database-supported electronic land register, which is intended to replace current practice. The Bavarian Ministry of Justice has commissioned T-Systems to design a suitable concept.
The new system will be used to manage the around 40 million land registers in fully structured form as well as to support the corresponding processes. It will also be implemented to make greater use of the possibilities that information technology holds for land registration management and to increase the legibility of land record excerpts for citizens. In the process, changes in laws and decrees may be necessary.
The new solution allows title registration offices to electronically send certified excerpts to other authorities, notary publics and businesses. With the same technology, notaries public can submit changes and entries electronically instead of having to use the postal system. By connecting legal correspondence to the electronic database, it should take less time to place entries into a land register. This enables building owners, for example, to repay bridging loans more quickly.
Because the different systems of the German federal states still rely heavily on paper files, is has not been possible to process land registers solely based on electronic records. This is why many land registers exist as an electronic duplicate of the original on paper, which can neither be modified nor searched. Later changes such as a new owner or a mortgage are separately filed in their database.
The new electronic land register will no longer rely on the original paper file and will save all of the information electronically. This makes the legibility of the information contained on the copies easier, and the files only contain the most up-to-date information. Additionally, the approach improves research possibilities in the electronic land register, which, once it has been approved, will eventually enable a fully electronic search of the record.
